Entry rules

1. The Dream Yacht Worldwide (“DYW”) Photo & Video contest (the “Contest”) is open to all clients who booked a DYW cabin cruise starting in August or September 2024. 
2. There will be Five (5) Categories for the best photos/videos submitted as below:
   – Life on board
   – Destinations
   – On board cuisine
   – Watersports
   – Short video/reel
   
3. In order to enter the Contest you must submit your photos/videos along with your booking reference, name, email address, and country of residence on this website – https://www.dreamyachtcharter.com/landings/ambassador-contest/ before 11 October, 2024 at 17:00 CET.
4. The Contest is free to enter for all clients who booked a DYW cabin cruise starting in August or September 2024, either through DYW direct sales or an agent of DYW. There can be only 1 participant per cabin booking. 
5. Each photo/video submitted is classed as one “Entry”, and more than one, the “Entries”. By submitting an Entry you will be deemed to have irrevocably agreed to these Terms and any terms and conditions cross-referenced in these Terms.
6. To be eligible for the Contest and submit a valid Entry, you must
   (a) be over 18 years of age;
   (b) not be an employee of any DYW company or a family member of such an employee; and
   (c) accept these Terms.
7. The Contest opening time will be 01 August, 2024 8:00 CET. All entries must be received by 17:00 CET on 11 October, 2024. If you submit an Entry after the Closing Time you will not be entered into the Giveaway.
8. Each participant must submit a minimum of five images and a maximum of 10, and/or a minimum of two videos and a maximum of five for the category or categories they wish to enter. All additional Entries will be automatically disqualified. 
9. The participant(s) must be the author(s) of the photos submitted in their name.
10. The participant(s) must be the copyright holder(s) or have been authorized by the copyright holder(s) to submit the photos/videos.
11. Photographing and filming children and teenagers can be highly sensitive, as they are more vulnerable and not always able to make good judgments for themselves. As a result, DYW will disqualify any Entry with children or teenagers in it. 
12. Entries must meet the technical requirements. All photographic images must be uploaded in single frame, JPEG format with high-quality compression (for example polyptychs, photo collages, etc.) with the original pixel size (unless cropped). Do not scale and do not change the resolution. ICC profile must be embedded. Adobe RGB, sRGB or grayscale Gamma 2.2 are recommended. No CMYK. Video files must be uploaded in .mov or .mp4 and have high-quality compression. Please remove opening and/or closing credits. Reels must be no longer than 15 seconds and videos, no more than 1 (one) minute.
13. The winning & runner-up Entries will be selected from the valid Entries by the Dream Yacht Marketing Department as below:
    – Two (2) winning Entries (the “Winner”), for the best photo and the best video
    – Ten (10) runner-up entries (the “Runner-up), with 2 Runner-up for each category as described in article 2
    Winners & Runner-ups will be chosen by DYW during the week of 14 October, 2024 and will be notified via email as soon as possible. The Winners & Runner-ups must accept the Prize by replying to the email within 48 hours of being notified as the Winner or Runner-up. If DYW does not receive a response within 48 hours of when DYW first tries to contact the relevant Winners and Runners up, DYW reserves the right to award the Prize to another entrant and the original Winner will forfeit all rights to the Prize. Thereafter the alternative entrant shall be the Winner for the purposes of these Terms.
14. The Winner prize is (for each of the two Winners) ONE (1) double cabin for two people on the seven-night Cabin Cruise charter in the Bahamas or Italy departing on mutually agreeable dates between 15 October 2024 and 31 May 2025, subject to availability & blackout dates. Blackout dates for Bahamas Cabin Cruise: 21 December 2024 to 04 January 2025. 
15. The Winner prize does not include flights, travel insurance, destination fees, food (other than while on the yacht where meals are included), alcoholic drinks, any transfers, taxis, car rentals, excess baggage fees or airport taxes, or any other personal expenses.
16. The prize is non-transferable, non-endorsable, non-refundable, non-negotiable and has no cash redemption value or cash alternative. 
17. The Winner prize certificate will contain all the relevant contact details required for the Winner to make the reservations.  The certificate will be subject to any terms printed on it or in any accompanying letter or memo.  The prize certificate will contain all the relevant details for booking the Prize and the Winner will be solely responsible for making the arrangements in order to redeem their Prize. Failure to follow the instructions or to make a reservation will result in the Prize being forfeited.
18. The Winner prize and each element comprising the Prize are not transferable or exchangeable. The Prize has no cash value and cannot be taken as cash or for any other item or benefit. If for any reason the Winner does not make use of the Prize including if the Prize is not claimed or redeemed, they shall not be entitled to any alternative prize. In each case, no refund or compensation will be provided.
19. In the event of a breach by the Winner of these Terms or any other terms incorporated into these Terms by reference, DYW reserves the right to withdraw the Prize and shall not be obliged to offer an alternative.
20. The Winner enjoys the Prize at its own risk. The Winner is responsible for safeguarding his or her property when enjoying the Prize and DYW and the DYW companies shall not be liable for property lost, stolen or damaged at the event.
21. The Runner-up prize (for each of the 10 Runner-ups) is a voucher of 500 € (or 550 US$), redeemable on your next Cabin Cruise with DYW.
22. The Runner up prizes are subject to terms and conditions, and can only be used on new bookings and cannot be used in conjunction with any other offers, except for any ‘Repeater Discount’.
23. For all Entries except awarded entries, copyright holders grant DYW non-exclusive use of photos/videos on DYW and associated media channels, without any remuneration being due.
24. By submitting an Entry, you consent to the use of your Entry on Dream Yacht Worldwide and associated social media channels.
25. The Winner(s) agree(s) to take part in a post Cruise (The Prize) interview that will consist of answering some questions about your experience via email on your return, which will be used for future marketing activity. 
26. Copyright holders retain copyright of their work. For Winner & Runner-up Entries, copyright holders grant DYW unlimited non-exclusive use of high-resolution photographs and videos for activities in all media, including social media, online and print, and all promotional and educational activities for and under the auspices of DYW, without any additional compensation being due. 
27. The authorization covers the use of data for any future marketing campaign, for the following purposes and in accordance with legislation: creation of audiences for targeting paid marketing campaigns on social media platforms or advertising networks, including but not limited to Meta and Google. These campaigns may be conducted globally worldwide and in all languages. Data will be retained as long as necessary for the purposes mentioned above, in accordance with our current legislation. You have the right to access your personal data, request its correction or deletion, or object to its use for the purposes mentioned. Participation in this giveaway implies full acceptance of these terms and the processing of your personal data as described above.
28. The copyright holders represent and warrant that submission of the entries does not breach any law, and further that no third party can hold any claims or any objections regarding the rights granted to DYW specified in articles 25 to 27. The copyright holders will hold DYW harmless of any claims from third parties related hereto.
29. Responsibility for determining the operation and results of the Contest including eligibility and the ultimate Winners, and all decisions relating to the Prize rests solely with DYW. DYW decision shall be final and binding and no correspondence will be entered into concerning any of these matters.
30. Any person found to be submitting unsolicited bulk messages (i.e. spam) will be disqualified from the Contest.
31. DYW can, in its absolute discretion, disqualify any entrant for breach of or non-compliance with these Terms or the submission of any material containing obscenity, defamation, an invasion of privacy or other objectionable content. DYW may vary or amend these Terms, change the Prize or terminate this Giveaway without prior notice. You agree that no liability shall attach to Dream Yacht Worldwide or any other Dream Yacht Worldwide company as a result thereof and that, in such circumstances, no compensation will be payable.
32. If you do not correctly submit your Entry in accordance with these Terms, you will not be eligible to win the Prize. Dream Yacht Worldwide takes no responsibility for any Entries that are lost, delayed, corrupted, damaged, incomplete or otherwise invalid. Dream Yacht Worldwide will not be responsible for any technical fault or failure which prevents a person from entering the Giveaway.
33. Your entry and participation in the Contest will also be subject to the DYW terms and conditions of usage found at https://www.dreamyachtcharter.com/gb/terms-and-conditions/
34. DYW reserves the right, at its sole discretion, to amend these Terms or to withdraw, amend, cancel the Giveaway at any time and without notice. No liability shall attach to DYW or any DYW company as a result thereof and, in such circumstances, no compensation will be payable. Any changes to these terms will be posted on this page.
35. By entering, your personal information (including your name, email address, country of residence and telephone number) will be collected, stored and processed by DYW in accordance with our Privacy Policy for the purposes of managing the Contest. Such information will not be used for any other purpose than as stated in these Terms or as separately accepted by you. DYW may contact you by email from time to time to tell you about DYW activities and news. You may unsubscribe from any such communication at any time by notifying us via http://www.dreamyachtcharter.com/gb/
    
36. Neither DYW nor any DYW company shall be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, volcanic eruption, earthquake, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion or any other circumstances beyond the control of that of DYW company.
37. This Contest is governed by the laws of Mauritius and any dispute arising from this Contest shall be subject to the exclusive jurisdiction of the relevant Courts of Port Louis (Mauritius).
